These Terms and Conditions ("Terms") govern your access to and use of the Virtual Receptionist services ("Services") provided by Mastres Marketing ("we," "us," or "our"). By submitting a demo request, signing up, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Mastres Marketing provides AI-powered voice receptionist services designed to answer incoming telephone calls on behalf of your plumbing business, qualify leads, capture caller details, and provide general call-handling assistance. The Services are intended to support — not replace — your business operations. We do not guarantee that the AI will handle every caller request perfectly or without error.

You represent that you are at least 18 years of age, that you have the legal authority to bind your business to these Terms, and that the contact and business information you provide is accurate and current.

The Services may record, transcribe, and analyze calls to provide and improve the Virtual Receptionist. You are responsible for complying with all federal, state, and local call-recording and consent laws (including two-party consent requirements) applicable to your business. Mastres Marketing may provide an automated disclosure, but you remain solely responsible for legal compliance.

Mastres Marketing may send SMS or text messages to you (the client) regarding appointments, onboarding, and go-live status. We do not send messages to your customers or on your behalf. All messages are sent through an A2P 10DLC-registered and verified messaging account owned and maintained by Mastres Marketing. By providing your phone number, you acknowledge and agree that:

• Consent: You consent to receive transactional and informational SMS messages from Mastres Marketing related to your account, appointments, onboarding, and go-live notifications, as permitted under the Telephone Consumer Protection Act (TCPA) and applicable law.
• A2P 10DLC registration: Mastres Marketing owns and maintains the A2P 10DLC brand and campaign registration for the messaging account used to deliver messages to you. You are not responsible for carrier registration.
• Message frequency: Message frequency varies based on your onboarding and appointment schedule. You may receive multiple messages during onboarding and around scheduled appointments.
• Opt-out: You may opt out of SMS messages at any time by replying "STOP." Opt-out requests are honored promptly and automatically. Reply "HELP" for support. Mastres Marketing maintains opt-out records as required by carrier and TCPA rules.
• No guarantees: We do not guarantee delivery of any SMS message. Message delivery depends on carriers and is outside our control.
• Data rates: Message and data rates may apply based on your mobile carrier plan.

Fees for the Services are described in the plan you select or in a separate agreement. Unless otherwise stated, fees are billed in advance on a recurring basis. You authorize us to charge your designated payment method for all applicable fees. Refunds, if any, are at our sole discretion. Prices may change with reasonable prior notice.

We may offer a free demo or trial period. Trial features and duration are at our discretion and may be modified or discontinued at any time. Providing a demo does not obligate you to purchase, nor does it obligate us to provide ongoing Services.

All software, AI models, branding, and content provided as part of the Services remain the property of Mastres Marketing or its licensors. You retain all rights to your business name, information, and customer data you provide to us.

We handle information you provide in accordance with our Privacy Policy. You are responsible for ensuring you may lawfully share any customer or caller information that flows through the Services.

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that every call will be handled to your satisfaction.

To the maximum extent permitted by law, Mastres Marketing and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, customers, or data, arising out of or related to the Services. Our total aggregate liability for any claim shall not exceed the amount you paid us for the Services in the three (3) months preceding the claim.

You agree to indemnify and hold harmless Mastres Marketing from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any law or third-party rights (including call-recording and consumer-protection laws).

You may cancel the Services at any time, subject to your billing cycle. We may suspend or terminate your access if you breach these Terms or if your use poses a risk to us or others. Upon termination, your access to the Services ceases, and we may delete associated data after a reasonable retention period.

We may update these Terms from time to time. We will notify you of material changes by email or within the Services. Continued use after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the jurisdiction in which Mastres Marketing is organized, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of its courts for any dispute arising from these Terms.
